Texas congressman Dan Crenshaw astutely noted this morning on Fox & Friends that the president’s duty as head of the executive branch is to execute the laws on the books, such as preventing illegal immigration (because it’s illegal), therefore Trump’s emergency declaration for more border fencing is justified (since Congress doesn’t want the president to execute this particular law).
