Roe v. Wade as law is a classic example of judicial activism, courts making law instead of legislatures, so now that it’s overturned, the U. S. Congress could pass a law for abortion like Roe v. Wade, and the state legislatures could too (in 10th Amendment accord); we’ll see how it all shakes out in the legislatures.
