Why Did Congress Clarify by Legislation What VP Pence Supposedly Did Rightly on J6 When Precedent Ostensibly Set?

Vice president Mike Pence after the 2020 election did what supposedly the law said that he should when on January 6th of 2021, he refused to send the contested Electoral College votes back to the states for them to reconsider (not necessarily to reverse), so didn’t that set the precedent and therefore why did Congress feel compelled to change the law in order to “clarify” the vice president’s role?
