Team Trump is probably quite confident in declaring a national emergency considering laws already enforce such as Title 10 of U. S. Code section 284 which enables the president to install border barriers to keep out international criminal organizations, obviously including human traffickers, terrorists, drug smugglers, and coyotes with their clients complicit in the scheming, so judges looking at the case will be very hard pressed to not see the efficacy of the emergency declaration for national defense, after all, a nation without enforced borders is really no nation at all.
